Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and FanPilott (“FanPilott”, “we”, “us”) governing your access to and use of the FanPilott website, applications and services (the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use & Content Policy, and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is for creating clearly fictional, adult, non-explicit content. You are responsible for all activity under your account.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately of any unauthorized use.

3. Acceptable use & content

Your use of the Service is subject to our Acceptable Use & Content Policy. FanPilott is strictly non-explicit: nudity, sexually explicit material, and any NSFW or adult content are prohibited, as is any content involving minors. Generations are automatically moderated, and we may reject, remove, suspend or terminate for violations, without refund.

4. Subscriptions, credits & billing

  • The Service is offered on paid, subscription plans with a monthly credit allowance.
  • Credits are consumed per generation. Credits reset each billing cycle and do not roll over.
  • Plans renew automatically until cancelled. You authorize us and our payment processor to charge your payment method on each renewal.
  • You may upgrade, downgrade or cancel from your account. Upgrades are prorated; downgrades take effect the next cycle.
  • A free trial, where offered, converts to a paid plan unless cancelled before it ends.
  • Pricing may change; we will give notice of changes for future billing periods.

Payments are processed by our third-party payment provider. Refunds, where available, are governed solely by our Refund Policy.

5. Your content and license

You retain ownership of the reference material you lawfully upload and, subject to these Terms and applicable law, of the outputs you generate. You represent that you have all rights necessary to your inputs. You grant us a limited license to host, process and display your content solely to operate and improve the Service.

Reference material, likeness & consent

If you upload photographs or other material depicting a real person — including yourself — you represent and warrant that you have the legal right to do so, and that you hold documented, informed consent from that person to create and publish AI-generated depictions of them. You must not upload material depicting:

  • any person under 18, or any person who appears to be a minor;
  • any identifiable person who has not given you express written consent;
  • public figures, celebrities or other third parties whose likeness you are not authorised to use;
  • any person in a manner intended to impersonate, defame, harass or sexualise them without their consent.

Creating non-consensual intimate imagery, or sexualised depictions of a real person without their consent, is strictly prohibited and may be a criminal offence in your jurisdiction. You are solely responsible for obtaining and retaining evidence of consent, and for any claim arising from a likeness appearing in your inputs or outputs.

Connected accounts & auto-posting

You may connect third-party accounts (such as Fanvue) so the Service can publish content to them on your behalf, either manually or automatically when you enable auto-posting. By connecting an account and enabling posting you authorise us to upload media and create posts to that account using the access you grant, and you confirm you are permitted to do so under that platform’s own terms.

You remain solely responsible for everything published through a connected account, including its compliance with that platform’s rules and applicable law. Scheduling and delivery are ultimately controlled by the connected platform; we do not guarantee that any post will publish, remain published, or reach any audience, and we are not liable for a connected platform’s acts, outages, moderation or account actions. You can disconnect an account at any time from the model’s page, and revoke our access in the platform’s settings. See our Privacy Policy for how connection tokens are stored.

6. AI-generated output

Nature of outputs, and defects

All images, videos and text produced through the Service are synthetic and fictional, generated by third-party AI models on a best-effort basis. Generative AI is inherently unpredictable. Outputs may contain defects, artifacts, distortions, anatomical or visual errors, unintended details, inaccuracies, or content that does not match your prompt. Generations may also fail, time out, or be rejected by a provider’s automated moderation. This is a normal characteristic of the technology and is not a fault in the Service.

Credits are consumed when a generation is submitted and processed. Credits are not refundable merely because you are dissatisfied with the aesthetic quality of an output, or because an output contains defects of the kind described above. Where a generation fails for technical reasons attributable to us, we will generally return the credits automatically.

No guarantee of uniqueness or ownership

We do not warrant that outputs are unique, original, non-infringing, or protectable as intellectual property. Similar or identical outputs may be generated for other users from similar inputs. The legal status of AI-generated works varies by jurisdiction, and in some jurisdictions you may not be able to claim copyright in an output.

Your responsibility

You are solely responsible for reviewing every output before you use it, and for how you use, publish, distribute, sell or monetise it. This includes ensuring each output complies with the rules of any platform on which you publish, with any applicable AI-disclosure or labelling laws, and with all other applicable law. Where required by law or by a platform, you must clearly disclose that content is AI-generated.

No liability for outputs

To the maximum extent permitted by law, FanPilott is not liable for any output, for any defect in an output, or for any consequence of your use of an output. This includes, without limitation: loss of or damage to your accounts on any third-party platform (including suspension, demonetisation or termination); claims by any third party (including claims relating to likeness, rights of publicity, defamation, or intellectual property); regulatory or law-enforcement action; reputational harm; and lost revenue or profits. You generate, review and use outputs entirely at your own risk.

7. Intellectual property

The Service, including its software, branding and design, is owned by FanPilott and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms.

8. Suspension & termination

We may suspend or terminate your access at any time for violation of these Terms or our policies, or to protect the Service or others. You may stop using the Service at any time. Termination for a violation does not entitle you to a refund.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that outputs will meet your expectations, be free of defects, be accurate, or be fit for any particular purpose or for any particular platform. We do not endorse, verify or take responsibility for any content generated through the Service.

10. Limitation of liability

To the maximum extent permitted by law, FanPilott will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim will not exceed the amount you paid us in the three months before the event giving rise to the claim.

This limitation applies to all claims, including any claim arising out of or relating to generated content, defects in generated content, the likeness of any person appearing in your inputs or outputs, or your publication, sale or other use of any output.

11. Indemnification

You agree to indemnify and hold FanPilott harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date. Continued use of the Service after changes take effect constitutes acceptance.
